Abstract

The human and political problems presented by refugees and asylum are acute and are not improving. This is reflected in international concern and the existence of a treaty framework. The emergent body of refugee law is an amalgam of international, regional and national rules and procedures. But it is national law and practice, particularly with regard to immigration, which in reality determines an individual's right to asylum. The key to a true appreciation and understanding of the plight of refugees and the extent of their current rights therefore lies in national law and practice. This text is a comparative study of the relevant law and practice of six European States. It supplies some essential groundwork for the development of common law and policy in this vital area within the enlarged European Union.

Abstract

How is access to asylum and other forms of extraterritorial protection regulated in the European Union? Is the EU acquis in these areas in conformity with international law? Which tools does international law offer to solve collisions between both? And, finally, is law capable of bridging the foundational oppositions embedded in migration and asylum issues? This volume is about the transformation of asylum in Europe in the context of the EU enlargement process. This transformation involves norms, as well as the procedures and resources for their implementation. In the candidate countries, as in the west, the process of transformations is marked by the tension between the interests of protection and migration control. Through their comprehensive analysis, the authors illuminate the legal and political dynamics which underlie this tension. Chapters trace the complex patterns of national, sub-regional and EU law and policy that are driving the future of asylum in an expanded Europe. This allows for reflection on what the transformation process tells us about the current EU asylum acquis, and what it tells us about the prospects for refugee protection in the new frontier states and beyond. This book is the result of a three year study carried out by academics and practitioners from the candidate countries, current Member States, and international organizations. It explores the evolution of refugee policy and practice in a changing Europe.

Abstract

Community asylum law is becoming ever more essential to asylum law in Europe. But many intricate questions about this new body of law remain to be resolved. Do the Community rules weaken or improve the position of asylum seekers? Would a future Community asylum law have to observe international norms? What role should the Court of Justice play in asylum matters? And does the communautarisation of asylum law affect the possibilities of asylum seekers to approach domestic courts, or the European Court of Human Rights? Abstract

Sidorenko analyses and evaluates the state of affairs of the Common European Asylum System (CEAS). The conclusions of the European Council meeting of Tampere are taken as a 'measuring instrument' to assess the current developments of the CEAS. The implementation in practice of the EU asylum legislation is also evaluated. For this purpose, the implications of the CEAS at a national level in an EU Member State are analysed. Slovakia, a new Member State, was chosen as an example due to its geographical location at the EU external border and the high number of asylum applicants present in this country. By examining EU and national asylum law against the background of international law (the 1951 Geneva Convention Relating to the Status of Refugees), a well-balanced critique of the CEAS is offered which provides views and expectations concerning its future direction.
